Please read our Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the http://www.padelmarket.com website operated by EUROPEAN PADEL MARKET, S.L. ("us" or "our").

Your access to and use of our Services is conditioned on your acceptance of and compliance with our Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service, you agree to be bound by our Terms and Conditions. If you disagree with any part of the terms, you may not access or use our Services.

1- Identification data

On the one hand, the provider of the goods or services on www.padelmarket.com, a website owned by EUROPEAN PADEL MARKET, S.L. which has its registered office at C/Doctor Esquerdo 105, 28007 Madrid and C.I.F. nº B05379060 and on the other hand, the CLIENT, registered on the website using a CLIENT name and password, for which he/she has full responsibility for use and custody, being responsible for the veracity of the personal data provided to the provider.

2- Purpose of the contract

The purpose of this contract is to regulate the contractual relationship between EUROPEAN PADEL MARKET, S.L. (hereinafter PADEL MARKET) and the CUSTOMER at the time when the latter accepts the corresponding box during the online contracting process.

The contractual relationship of sale involves the delivery, in exchange for a determined price and publicly displayed through the website, of a specific product or service.

3- Conditions of access and use of this website

Access to this website is the sole responsibility of the users, and implies acceptance and knowledge of the legal warnings, conditions and terms of use contained therein. PADEL MARKET reserves the right to make, at any time, the changes and modifications it deems appropriate and necessary for the website without prior notice.

In order to access the services offered by the provider, the CUSTOMER must register through the website by creating a CUSTOMER account. To do so, the CUSTOMER must freely and voluntarily provide the personal data that will be required.

The CUSTOMER will select a CUSTOMER name and a password, committing to make diligent use of them, and not to make them available to third parties, as well as to notify the service provider of the loss or theft of them or of possible access by an unauthorized third party, so that the latter proceeds to immediately block them.

The CUSTOMER may not choose as CUSTOMER name words that are intended to confuse others by identifying him/her as a member of the provider, as well as foul, insulting expressions and, in general, contrary to the law or the requirements of morality and good customs.

Once the CUSTOMER account has been created, it is reported that in accordance with the requirements of art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:

1- Select the shipping details where you want to receive the purchased product

2- Select the payment method

3- Use the discount code if applicable

4- Fill in the comments on your order if applicable

5- Select the billing address

6- Confirm the order

In any case, the provider's contracting platform will inform the CUSTOMER, once the contracting procedure has been completed, via email regarding all the characteristics, price, forms of transport, contracting date and estimated delivery of the contracted product or service.

3.1. Veracity of the information

All information provided by the User through the Services must be true. For these purposes, the User guarantees the authenticity of all data communicated as a result of completing the forms required to subscribe to the Services. Likewise, it will be the User's responsibility to keep all information provided to PADEL MARKET permanently updated so that it reflects, at all times, the User's real situation. In any case, the User will be solely responsible for any false or inaccurate statements made and for any damages caused to PADEL MARKET or third parties due to the information provided.

3.2. Minors

In order to use the Services, minors must obtain prior permission from their parents, guardians or legal representatives, who will be considered responsible for all acts carried out by minors in their care.

Full responsibility for the content accessed and the actions taken by minors lies with the adults in charge of them.

3.3. Obligation to make correct use of the Site and the Services

The User agrees to use the Site and the Services in accordance with the law, this Legal Notice, the Specific Conditions of certain Services and other notices, regulations of use and instructions made known to him/her, as well as with generally accepted morality and good customs and public order.

To this end, the User shall refrain from using any of the Services for purposes or effects that are illegal, prohibited in this Legal Notice, harmful to the rights and interests of third parties, or that in any way may damage, render useless, overload, deteriorate or prevent the normal use of the Services, computer equipment or documents, files and all kinds of content stored on any computer equipment (hacking) of PADEL MARKET, other Users or any Internet user (hardware and software).

3.4. Obligation to make correct use of the Contents

Pursuant to the provisions of clause 3.3, the User undertakes to use the content made available to Users on the Site, including, but not limited to, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter, the "Content"), in accordance with the law, this Legal Notice, the Particular Conditions of certain Services and other notices, regulations of use and instructions made known to the User, as well as with generally accepted morality and good customs and public order, and, in particular, undertakes to refrain from:

(a) Reproducing, copying, distributing, making available or otherwise publicly communicating, transforming or modifying the Content, unless authorized by the owner of the corresponding rights or legally permitted;

(b) Delete, manipulate or in any way alter the copyright and other identifying data of the reservation of rights of PADEL MARKET or its owners, the digital fingerprints or any other technical means established for their recognition.

The User must refrain from obtaining or even attempting to obtain the contents using means or procedures other than those which, depending on the case, have been made available for this purpose or have been indicated for this purpose on the web pages where the Contents are found or, in general, those which are normally used on the Internet for this purpose, provided that they do not entail a risk of damage or disabling of the Site, the Services and/or the Contents.

Users and, in general, those persons who intend to establish a hyperlink between their website and the Site (hereinafter, the "Hyperlink") must comply with the following conditions:

(f) The website on which the Hyperlink is established shall not contain information or content that is illegal, contrary to morality and generally accepted good practices and public order, nor shall it contain content that is contrary to any third party rights. The establishment of the Hyperlink does not imply in any case the existence of relations between PADEL MARKET and the owner of the website on which it is established, nor the acceptance and approval by PADEL MARKET of its contents or services.

4. Industrial and intellectual property rights

The User undertakes to respect the industrial property rights of PADEL MARKET and any other third party. The use or granting of access to the Website does not entail the granting of any right over the trademarks, trade names or any other distinctive sign used therein.

The User may download the Website to his/her terminal provided that it is for private use, without any commercial purpose, and therefore may not exploit, reproduce, distribute, modify, publicly communicate, transfer, transform or use the content of the Website for public or commercial purposes.

Furthermore, the Contents are the intellectual property of PADEL MARKET, and none of the exploitation rights or any other rights that exist or may exist over said Contents may be understood to be transferred to the User, by virtue of the provisions of this Legal Notice, beyond what is strictly necessary for the correct use of the Website.

5. Duration of service.

PADEL MARKET does not guarantee the availability and continuity of the operation of the Website. When reasonably possible, PADEL MARKET will give advance notice of any interruptions in the operation of the Website. PADEL MARKET also does not guarantee the usefulness of the Website for carrying out any specific activity, nor its infallibility.

Access to the PADEL MARKET Website has an indefinite duration; however, PADEL MARKET reserves the right to suspend without prior notice access to Users who, in its opinion, fail to comply with the rules for using its Website and to take appropriate legal action. In addition, it reserves the right to restrict access to some sections of the Website to the general public, limiting it only to specific users or groups of users through the provision of an access password for which they will be responsible.

6. Exclusion of liability

PADEL MARKET makes every effort to avoid any errors in the content of the website.

The website expressly reserves the right to delete any comment or opinion that violates the provisions of point 3.

PADEL MARKET excludes any liability for damages of any kind arising from:

- The interruption of operation or lack of availability of access to the website.

- The privacy and security in the use of the website by the User, and/or unauthorized access by unauthorized third parties.

- The eventual transmission of elements that negatively affect computer systems.

- The accuracy, completeness and timely updating of the contents of its website.

7. Use of cookies

8. Protection of personal data.

The personal data supplied by the User in the forms that he/she fills out will be processed automatically and incorporated by PADEL MARKET into files owned by it, on which the security measures required by current legislation will be adopted to guarantee their confidentiality.

The personal data will be used exclusively for the purpose stated in the data collection form.

PADEL MARKET guarantees the correct use of personal data and will not communicate or transfer personal data to third parties, treating them with the appropriate confidentiality.

The data that you provide us will be incorporated into a PADEL MARKET file, for the purpose of sending you informative and/or commercial communications by email and mobile phone. You may exercise your rights of access, rectification, cancellation and opposition by written communication, addressed to PADEL MARKET C/Doctor Esquerdo 105, 28007 Madrid

9. Order delivery

Orders will be delivered to the delivery address freely designated by the CUSTOMER. Therefore, the provider assumes no responsibility when the delivery of the product or service does not take place as a result of the data provided by the CUSTOMER being false, inaccurate or incomplete or when the delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the recipient.

10. Price and validity period of the offer

The prices indicated for each product include Value Added Tax (VAT) or other taxes that may be applicable. These costs, unless expressly stated otherwise, do not include shipping, handling, packaging, shipping insurance or any other additional services and annexes to the product or service purchased. The prices applicable to each product will be those published on the website and automatically applied by the contracting process in the last phase of the same. The client assumes that in any case the economic value of some of the products may vary in real time. In any case, this will always be communicated in advance to the CLIENTS.

For any information about the order, the CLIENT will be sent via email to the email address info@padelmarket.com. In any case, the order number assigned to you and indicated in the purchase confirmation email must be indicated in the subject of the message.

By purchasing with Scalapay you will receive your order immediately and you will pay in the number of installments you have established. You agree that the Terms are assigned to Retail Instalments SPV 1 Limited, its related parties and their assignees and authorize such assignment.

11. Right of Withdrawal

The CUSTOMER will have a period of 14 working days from the date of receipt of the product to return it by contacting the customer via email at info@padelmarket.com. In any case, the costs related to shipping will be borne by the customer (in accordance with the consequences of the Right of Withdrawal) and the product must be returned in conditions that allow its subsequent sale.

11.1. Consequence of the Right of Withdrawal

In the event that you exercise your right to withdraw, the refund will be made using the same channel or means of payment used by you to purchase the returned item. In particular, in the event of a situation that does not allow its return through the normal channel, alternative methods will be established to ensure receipt and not contravene any accounting or tax regulations of the Spanish State. PADEL MARKET may withhold the refund until it has received the goods. The CUSTOMER will be responsible for any decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of said goods.

12. Applicable Guarantees

All products offered through the website are completely original, unless otherwise indicated in their description.

In accordance with current regulations regarding consumer goods guarantees, our products have a 2-year guarantee from the date of the purchase invoice, although during the first months the defect that the product may present is presumed to be factory-originated, unless proven otherwise, and the customer must prove that it is also a factory-originating defect if it occurs after the sixth month and before two years. Always with an invoice or purchase receipt.

If before the sixth month, or the period of time established by the manufacturer in writing on the item's label, there is a deterioration in the item and the customer suspects that it may be due to a manufacturing fault, they may make use of the guarantee by contacting our online customer service in the shipping and returns section of the website where they made the purchase.

PADEL MARKET will process the guarantee with the technical service of the product brand. Once the item has been analysed by the technical service, there are three possible situations:

- That the technical service fixes the product and it is returned to the customer.

- That the technical service exchanges the item for a new one. In this case, the same item will always be returned, and it will not be possible to exchange it for a different one (except in the case of lack of stock).

- That the technical service determines that the product does not have a manufacturing fault and that the exchange or repair is not appropriate. In this case, the customer will be returned the original product.

13. Legislation and jurisdiction

The provision of the service is governed by Spanish law, and the Courts of the consumer's domicile are competent, to which the User expressly submits.
